Terms of Use

Effective date: [effective date] · Last updated: October 14, 2026

The short version

  • HEYTOUR is a marketplace. Local, verified businesses ("partners") run the tours, transfers and other experiences. Your contract for the experience is with the partner; HEYTOUR runs the app, takes your payment for the partner and helps when something goes wrong.
  • You pay the price you see. We don't add a booking or service fee.
  • We save your card when you book. The full price is held on it 4 days before the start and charged 48 hours before the start.
  • Cancel for free until the charge (48 hours before the start). After that, there's no refund.
  • If the partner cancels, declines or doesn't answer your request, you get everything back.
  • AI trip plans and translations help you choose, but can be wrong. The listing and the partner's confirmation are what count.

This summary doesn't replace the full terms below.

1. About these terms

These Terms of Use ("Terms") are an agreement between you and Clevers LLC ("HEYTOUR", "we", "us"). They apply when you use HEYTOUR as a traveller: our website (https://heytour.ai), our mobile apps, our web app and the payment pages we send you links to (together, the "Platform").

By creating an account, making a booking or otherwise using the Platform, you agree to these Terms and confirm you've read our Privacy Policy. If you don't agree, please don't use the Platform.

Businesses that sell on HEYTOUR agree to separate partner terms. These Terms are for travellers.

2. What HEYTOUR is, and who you contract with

  • We run a marketplace. HEYTOUR lets you find, plan and book tours, activities, private guides, photoshoots, transfers and custom trips ("experiences"), mostly in Uzbekistan. We don't run the experiences ourselves.
  • Partners run the experiences. Each experience is offered by an independent local business (a "partner"), such as a tour operator, guide or transfer company. Before a partner can sell on HEYTOUR, we check its business details and documents. Checking a partner doesn't mean we supervise its day-to-day work.
  • Your contract for the experience is with the partner. When a booking is confirmed, a contract for that experience is formed directly between you and the partner. The partner is responsible for delivering it as described, for its guides, drivers and vehicles, for safety, and for holding the licences and insurance the law requires. The partner's name is shown on the listing and on your booking.
  • Your contract with us is about the Platform. We're responsible for running the Platform, processing your booking, taking your payment on the partner's behalf, refunds under these Terms, and customer support.
  • Partners' own conditions. A listing may include the partner's requirements (for example a minimum age, a fitness level, what to bring or a luggage limit). They form part of your booking. If they conflict with these Terms, these Terms win on payment and cancellation.

3. Your account

  • You can browse and use the AI trip planner without an account. To book, message a partner, save listings or write a review, you need an account.
  • You must be at least 16 to create an account, and at least 18 (or the age of majority where you live, if higher) to make a booking. If you book for other people, you confirm you're allowed to accept these Terms for them and that you'll share the booking details with them.
  • Give accurate details and keep them up to date. Keep your sign-in methods (email, phone, password, and any Google or Apple account you sign in with) secure. You're responsible for what happens under your account. If you think someone else is using it, tell us at help@heytour.ai.
  • You can delete your account at any time in the app (Profile → Delete account). See the Privacy Policy for what happens to your information.

4. Booking

How a booking is made

You pick an experience, a date and time (or a pickup time and a vehicle for a transfer), the number of guests by age group, and give your details as the lead guest. Some listings ask questions or a pickup place. Then you add a card. You have 15 minutes to finish; after that the places we held for you are released.

Bookings close at least 3 hours before the start, or earlier if the listing says so.

Instant and request listings

Each listing says how it's confirmed:

  • Instant booking: your booking is confirmed as soon as your card is added.
  • Request to book: the partner must accept. They have 48 hours to answer (or until 2 hours before the start, if that's sooner). If they decline or don't answer in time, the request ends and nothing is charged (any hold on your card is released).

You'll get a confirmation by email and in the app with your booking number (it starts with "HT-"), the meeting point and instructions, the cancellation deadline and a QR code for check-in. You can add it to Apple Wallet, Google Wallet or your calendar.

Custom trips and offers

  • Custom trips: for listings marked "on request", you send the partner your dates, group and wishes. The partner may send you a quote. If you accept it and add your card, it becomes a confirmed booking. Quotes have an expiry date.
  • Offers by link: a partner you've talked to outside HEYTOUR can send you a payment link. You confirm it's you with a 6-digit code sent to your phone or email, and pay. The result is an ordinary HEYTOUR booking under these Terms. If you didn't have an account, one is created for you with the phone or email the code was sent to.

Transfers

A transfer is priced per vehicle, not per person. Airport transfers need your flight number. Once your booking is confirmed, you'll see your driver's first name, photo and phone number and the car's licence plate. The partner may assign a different driver or a comparable vehicle if needed.

5. Prices and payment

  • The price you see is the price you pay. We don't add booking or service fees for travellers. Our commission is paid by the partner from its share.
  • Currency. Prices are shown and charged in the listing's currency, usually US dollars. Your bank may charge a currency conversion or foreign transaction fee; that's between you and your bank.
  • What's included. The listing says what's included and what isn't (for example meals, entrance tickets or tips). Anything not included is paid separately, usually on the spot.
  • The price is locked when you book. A later price change on the listing doesn't affect your booking.
  • Taxes. [TO CONFIRM: whether listed prices include all applicable taxes, and who issues receipts or invoices.]
  • Payment processing. Payments are processed by Stripe. We never see or store your full card number. You can pay with a card, Apple Pay or Google Pay, and save cards in the app. We accept your payment as the partner's limited payment collection agent, and pay the partner after the experience; once you've paid us, you've paid the partner.

When your card is charged

When you book What happens
More than 4 days before the start Your card is saved. Nothing is charged. 4 days before the start, the full price is held on your card. 48 hours before the start, it's charged.
Between 4 days and 48 hours before Your card is saved and the full price is held right away. It's charged 48 hours before the start.
Less than 48 hours before The full price is held right away and charged as soon as the booking is confirmed (at once for instant bookings, offers and accepted quotes; when the partner accepts a request).

A hold reserves the amount on your card without taking it. If the booking is cancelled before the charge, the hold is released; how fast it disappears from your statement depends on your bank.

Example: you book on October 12 for a tour on November 18 at 9:00. Your card is saved on October 12, the price is held on November 14 at 9:00, and charged on November 16 at 9:00. You can cancel for free until November 16 at 9:00. All times are the experience's local time.

If the hold or payment fails

If we can't hold the price on your card, we'll email you and notify you in the app straight away, and send a text message 8 hours later if it's still unpaid. You can pay in the app with any card until the charge time (48 hours before the start). If it's still unpaid then, the booking is cancelled and nothing is charged.

Card checks

To protect travellers and partners from card fraud, we may ask you to confirm a large payment (for example $1,000 or more). We place a small temporary hold of a random amount on your card and ask you to enter that amount from your bank's app or statement. The small hold is always released, never charged. If the check isn't completed, we may cancel the booking with a full refund.

6. Promo codes

Partners create and advertise their own promo codes. To use one, enter it at checkout.

  • A code works only for the listing, dates and number of uses the partner set. One code per booking.
  • It's applied only if you enter it; a discount is never added by itself or after you've paid.
  • A code can't be exchanged for cash, and a discounted booking still costs at least $1.
  • If a booking is cancelled before it's charged, the code's use is given back (if the code is still valid).
  • Codes don't apply to custom-trip quotes or offers.
  • We may refuse a code that was obtained or used unfairly, for example by misuse, fraud or a clear pricing error.

7. Cancellations, changes and refunds

One rule applies to every booking on HEYTOUR:

  • Free cancellation until the charge (48 hours before the start). Cancel in the app before then and nothing is charged; any hold is released.
  • No refund after the charge. Once your card has been charged, cancelling, not showing up or arriving too late to join doesn't give a refund.
  • Booked less than 48 hours before? There's no free cancellation once the booking is confirmed and charged. For a request that the partner hasn't accepted yet, you can still cancel for free.

If the partner cancels. If the partner cancels your booking (or the whole session) for any reason, including bad weather or too few guests, you get a full refund of everything charged, or the hold is released. Some listings say they'll also offer you another date; you can always choose the refund.

If we cancel. We may cancel a booking if payment fails (section 5), if a card check isn't completed, if we reasonably suspect fraud or misuse, or if the partner can no longer provide it. If you did nothing wrong, you get a full refund.

Changes. To change the date, time or number of guests, cancel (free until the charge) and book again, or ask the partner in the chat. The partner doesn't have to accept a change.

Refund timing. Refunds go back to the card you paid with. They're usually sent within a few days; your bank may take 5–10 business days to show them.

These rules don't limit any rights you have under consumer law that can't be excluded. Note that in many countries the 14-day "cooling-off" withdrawal right doesn't apply to leisure services booked for a specific date, such as tours and transfers.

8. On the day

  • Check the meeting point, start time (always the experience's local time) and what to bring. Arrive on time and bring a phone we or the partner can reach.
  • Show your QR code (in the app, in Apple or Google Wallet, or a screenshot) so the partner can check you in.
  • Follow the guide's or driver's safety instructions and the local law. A partner may refuse to take you, without a refund, if you arrive late, or are a risk to yourself or others (for example if you're intoxicated or behave aggressively).
  • You're responsible for your own passport, visa, health requirements and travel insurance. Check that the experience suits your health, fitness and age, and tell the partner about anything important in "special requests" or the chat.
  • Children must be accompanied by an adult unless the listing says otherwise.

9. Messages and support

  • You can chat with a partner about a booking, a custom trip or a listing, and with HEYTOUR support. You can send text and photos.
  • Partners see your first name and the first letter of your last name. We don't share your email address or phone number with them through the chat. Don't share payment details in chats, and don't pay a partner outside HEYTOUR for a booking made on HEYTOUR: if you do, our refund rules and support can't protect that payment.
  • Our support and safety team can read conversations to help resolve problems, prevent fraud and enforce these Terms. You can report a conversation from the chat.
  • Be respectful. Don't use the chat for spam, harassment or anything unlawful.

10. AI trip planner and translations

  • AI trip planner. You can describe your trip and get a suggested day-by-day plan built from listings on HEYTOUR. Plans are made by AI. They're suggestions, not bookings, and may be incomplete or wrong (for example about timing, distances or opening hours). Always check the listing before you book. The prices and times in a plan come from the listings, and the listing at the time you book is what counts.
  • Translations. Partners write listings in English, Uzbek or Russian, and we may show them (and reviews) translated by AI. Translations can contain mistakes. If something is unclear or important to you, ask the partner in the chat.
  • Don't rely on AI output for safety, medical, legal or visa matters.

11. Reviews and your content

  • After an experience, you can rate it from 1 to 5 stars and write a review within 30 days. Only travellers who took part in a booking can review it, so every review is linked to a real booking.
  • Reviews must be honest and about your own experience. Don't include personal information about others, offensive or unlawful content, advertising, or anything you were paid or offered something to write.
  • Your review is public on HEYTOUR with your first name. The partner can reply publicly. We may show it translated.
  • We don't edit reviews, but we may hide a review that breaks these rules. We don't hide reviews because they're negative.
  • You keep ownership of what you write and upload (reviews, messages, photos, your profile photo). You give us a worldwide, non-exclusive, royalty-free licence to host, store, translate, display and share it as needed to run and promote the Platform (for example showing your review on the listing). This licence ends when the content is deleted, except for copies we must keep by law and reviews already published, which may stay up shown as "Deleted user".

12. Using the Platform properly

Don't:

  • make bookings you don't intend to keep, or book to resell without our permission;
  • use stolen cards or someone else's payment method, or file a chargeback for a charge you agreed to under these Terms;
  • scrape, copy or resell listings, prices or reviews, or use bots to access the Platform;
  • break, overload or get around the security or limits of the Platform, or access accounts or data that aren't yours;
  • impersonate anyone, post false information, or harass partners, guides, drivers, other travellers or our staff.

We may suspend or close an account, or cancel open bookings, if you break these Terms or the law, or to protect others. Where reasonable, we'll tell you first and explain why.

13. Complaints

If something isn't right during the experience, tell the partner or the guide straight away so they can fix it. If that doesn't work, contact us through support chat in the app or at help@heytour.ai with your booking number, as soon as you can and no later than [30 days] after the experience. We'll look into it, contact the partner, and reply as quickly as we can. Contacting us first doesn't affect your legal rights.

14. Our responsibility

  • The experience. The partner is responsible for the experience, its quality and safety, and for its guides, drivers and vehicles. We're not liable for a partner's acts or omissions, except where we're at fault ourselves (for example if we didn't process your refund under these Terms).
  • The Platform. We work to keep the Platform accurate and available, but listings are written by partners, and the Platform may sometimes be unavailable or contain errors. We provide it "as is" and, as far as the law allows, give no promises beyond those in these Terms.
  • Limits. As far as the law allows, we're not liable for indirect or consequential losses (such as lost profits or missed flights) or for events outside our reasonable control. Our total liability to you for any booking is limited to the amount you paid for that booking; for anything else, to [US $100].
  • What we never limit. Nothing in these Terms limits liability for death or personal injury caused by our negligence, for fraud, or for anything else that can't be limited by law. If you're a consumer, you keep all rights that the law where you live gives you and that can't be excluded by contract.

15. Third-party services

The Platform works with other companies' services, such as Stripe (payments), Apple and Google (sign-in, Apple Pay, Google Pay, Wallet), map and ride apps you choose to open, and the AI providers that power the trip planner and translations. Their own terms apply when you use them, and we aren't responsible for them.

16. Our content

The Platform, its design, software, and our name and logo belong to us or our licensors. Listings and photos belong to the partners. You may use the Platform for your own, non-commercial travel planning only.

17. Changes to these Terms

We may update these Terms, for example when we add features or the law changes. We'll post the new version here with a new date and, for important changes, tell you in the app or by email at least [30 days] before they take effect. Bookings already made keep the payment and cancellation rules that applied when you booked. If you don't agree with a change, you can stop using the Platform and delete your account.

18. Law and disputes

These Terms are governed by the laws of [the State of Delaware, USA], and disputes go to [the state and federal courts located in Delaware]. If you're a consumer, you keep the protection of the mandatory laws of the country where you live, and you can bring a claim in its courts. The contract for an experience between you and a partner may also be governed by the law of the country where the experience takes place.

We'd always rather fix a problem with you directly first, so please contact us before starting a formal dispute.

19. General

  • These Terms and the Privacy Policy are the whole agreement between you and us about the Platform.
  • If part of these Terms can't be enforced, the rest still applies. If we don't enforce a right straight away, we haven't given it up.
  • You can't transfer your rights under these Terms. We may transfer ours to a company that takes over the Platform, without reducing your rights.
  • These Terms are written in English. If we provide a translation and they differ, the English version applies, unless the law where you live says otherwise.
